PREMISES LIABILITY
Many of our clients have been injured due to hazardous conditions on the property of another. These are conditions of which our clients were unaware, but of which the property owners knew or should have known. In addition to structural and physical hazards on a property, these cases also include claims related to inadequate security or lighting, which can lead to criminal assaults or other victimization.
At Brown Moore & Associates, we have a team of experienced North Carolina personal injury attorneys who have successfully handled premises liability claims that have included, among others, injury at ski resorts, slip and falls at commercial stores due to placement of merchandise, injuries sustained because structures have not been built to applicable governmental building codes, and a criminal assault at a nationally-known hotel chain.
Premises liability cases involve a significant amount of investigation into prior similar occurrences, as well as interviews with individuals who have familiarity with the scene or premises. Often these cases involve expert testimony in the form of engineers and safety consultants. At Brown Moore & Associates our North Carolina personal injury attorneys retain an extensive list of both local and national experts in these fields. We can put this expertise to work for you in vigorous representation of your claim.
North Carolina is one of only a very few States left in the United States that clings to an old concept in the law that is known as "contributory negligence." What this means is that in most circumstances if an individual is the least bit at fault for their own injury, even fault as small as 1%, then that individual is not entitled to any recovery for their injuries. South Carolina, on the other hand, has adopted the prevailing thinking throughout the United States, which is known as "comparative negligence." Unlike in North Carolina, an individual may recover a portion of their damages as long as their fault for their own injuries is less than 50%.
Many times when an insurance representative contacts you in the days following an injury, they will seek to find evidence that you are partially at fault. Once that has occurred the insurance company may not be obligated to pay you any compensation. For this reason many attorneys are reluctant to handle these claims. At Brown Moore & Associates our North Carolina personal injury attorneys will explore every angle to seek to recover compensation for you.
Whether or not it is Brown Moore & Associates, we highly recommend that you speak with an attorney before speaking with an insurance representative after an premises injury. Even when the incident may have been caused in part by you, we may still be able to help you recover some compensation.
