The man was mentally unstable. During the conversation, Mims lunged at the police officer with a box cutter he had initially held against his own throat. The police shot and killed Mims on the spot.
The criminal case against the police officer was found not guilty. The district attorney ruled that the shooting was justified. However, the Mims family is not taking this plea.
